Washington County School District Policies

PPRA NOTICE AND CONSENT/OPT-OUT FOR SPECIFIC ACTIVITIES

 The protection of Pupil Rights Amendment (PPRA), 20 U.S.C. * 1232h, requires the Washington County School District to notify you and obtain consent or allow you to opt your child out of participating in certain school activities.  These activities include a student survey, analysis, or evaluation.  Full notice available at registration desk.


FERPA

The Family Educational Rights and Privacy Act (FERPA) and District Policy #3260 affords parents and students over 18 years of age (“eligible students”) certain rights with respect to the students education records. (Complete disclosure was included in the beginning of the year mailer.)

SAFE SCHOOLS POLICY

1. Purpose:

The Board of Education of the Washington County School District recognizes that every student in the schools should have the opportunity to learn in an environment, which is safe, conducive to the learning process, and free from unnecessary disruption. To foster such an environment the following policy has been adopted and is based on the

following principles:

2. Policy:

  • Each student is expected to follow accepted rules of conduct;
  • Each student is expected to show respect for other people and obey persons in authority at the school;
  • The policy applies to students while in the classroom, on school grounds, on school vehicles, and in school-related activities or events.
  • For mandatory School Reporting of Drug Use - refer to expulsion and attendance in Utah State Code 3.4.

3. Procedure:

 Definitions:

  • Suspension is not to be understood as the deprivation of a right to learning, but as the temporary denial of social interaction through school contact and the removal of the person from the classroom setting because of real and present disruptive effect of his/her presence, or a reasonable assumption that his/her presence will be disruptive or a threat to the well-being or safety of himself/herself and or other students or staff. Suspension may carry with it conditions which must be met to remove the suspension. Such conditions may be a joint responsibility of school personnel, the student and parents, or the sole responsibility of any one party. Suspension is for no more than 10 school days per incident.
  • Expulsion or Transfer Placement is defined as the removal from school for any period longer than 10 consecutive days but not more than 1 school year.
  • Temporary disciplinary transfer means a student is temporarily removed from the regular school setting by the school administration to an alternative educational setting because of a violation of the safe school policy.

Grounds For Suspension And Expulsion:

 A student may be suspended or expelled from school for any of the following reasons:

  • Frequent or flagrant willful disobedience, defiance of proper authority or\disruptive behavior; including the use of foul, profane, vulgar, or abusive language.
  • Willful destruction or defacing of school property;
  • Behavior or threatened behavior which poses an immediate and significant threat to the welfare, safety, or morals of other students or school personnel or to the operation of the school, including bullying, emotional, physical or sexual harassment (see policy 1425 on sexual harassment);
  • Possession or use of pornographic material on school property;
  • Possession, control, or use of an alcoholic beverage as defined in Section 32A-1-105 of the Utah Code;
  • Possession, control, or use of tobacco;
  • Behavior described in Section 3.2.2, which threatens harm or does harm to the school or school property, to a person associated with the school, or property associated with any such person, regardless of where it occurs.
  • Because of identification and association with gangs, the following will not be permitted on school campuses or at school activities: bandannas or any article of clothing bearing gang symbols, names, initials, insignia, or anything else that signals gang affiliation.
  • When a school official determines that time is needed to establish further facts of an act or series of acts of disobedience and misconduct disruptive to the learning process, which may lead to suspension or expulsion from school.

3.4  A student shall be suspended or expelled from school for any of the following    reasons:

  • Any serious violation affecting another student or staff member, or any serious violation occurring during school hours, including lunch/break time, in a school building, in or on school property, or in conjunction with any school activity, including:
  • Possession, control, or actual or threatened use of a real weapon, explosive, or noxious or flammable material under Section 53A-3-502;
  • The actual or threatened use of a look alike weapon with intent to intimidate another person or to disrupt normal school activities;
  • The sale, control, or distribution of a drug or controlled substance as defined in Section 58-37-2;
  • The sale, control, or distribution of an imitation controlled substance as defined in Section 58-37b-2;
  • The sale, control, or distribution of drug paraphernalia as defined in Section 58-37a-3.
  • The commission of an act involving the use of force or threatened force which if committed by an adult would be a felony or class a misdemeanor.
  • A student who commits a violation of section 3.2.2 above involving a real or look alike, weapon, explosive, or flammable material shall be expelled from school for a period of not less than one year, subject to the following:

 

Within 45 days after the expulsion, the student shall appear before the student's local school board superintendent or the superintendent's designee, accompanied by a parent or legal guardian; and the superintendent shall determine:

  • What conditions must be met by the student and the student's parent for the student to return to school;
  • If the student should be placed on probation in a regular or alternative school setting consistent with Section 53A-11-907, and what conditions must be met by the student in order to ensure the safety of students and faculty at the school the student is placed in; and
  • If it would be in the best interest of both the school district and the student to modify expulsion term to less than a year, conditioned on approval by the local school board and giving highest priority to providing a safe school environment for all students.

A student may be denied admission to school on the basis of having been expelled from that or any other school during the preceding 12 months. A suspension or expulsion under this policy is not subject to the age limitations under Subsection 53A-11-102(1).  During the time of suspension or expulsion the student may not be on school grounds for any reason without permission.  Failure to abide by this will result in meeting with the resource officer for a trespassing violation.

GENERAL STUDENT CONDUCT

Hurricane Middle School students are renowned for good citizenship.  We hope you will help us maintain our outstanding reputation.  We recognize that people make mistakes.   Those who choose the inappropriate behaviors listed here are subject to disciplinary action and possible referral to juvenile court:

  • Written or verbal insubordination toward any school staff member, especially substitute teachers
  • Truancy
  • Harassment
  • Sexual Harassment
  • Threats of bodily harm towards any student,  faculty or staff.
  • Public Display of Affection (PDA)
  • Possession or use of pornographic material
  • Being out of class without a hall pass
  • Sale, possession, or use of tobacco, alcohol, or other drugs on or near school property (possible felony)
  • Fighting/Assault - Both parties will be suspended for at least one day regardless of the circumstances. Fight promoters will be dealt with as seriously as the fighters
  • Vandalism, graffiti, malicious misuse or destruction of school property
  • False fire alarm, bomb threat (felony)
  • Theft of school or personal property
  • Destruction of school property
  • Cheating, plagiarizing, and forgery
  • Vulgarity, profanity and lewdness
  • The inappropriate use of cell phone and cameras
  • Bullying – If a student is bullied by another student, the incident should be immediately reported to a teacher or the administration.  Bullying will not be tolerated and will incur serious consequences.  

 INTERNET POLICY

 Washington county School District provides as service to the schools, a wide area computer network which includes access to the internet.  Internet use is a privilege, not a right, and inappropriate use will result in a loss of network privileges, disciplinary action, and / or referral to  legal authorities,  The system administrators will close an account when necessary.  An administrator or faculty member may request the system administrator to deny, revoke, or suspend specific user access and / or use accounts.  Complete disclosure policy must be signed by parent and student and is placed in SEOP folder.

 

GANG APPAREL AND PARTICIPATION

1. A Gang as defined in this policy means a group of three or more which has a unique name sign, symbol, or mark, and whose members engage in criminal or violent behavior to persons or property, or who create an unreasonable and substantial disruption or risk of disruption of a class, activity, program, or other function of a school.

2. Students are prohibited from engaging in any form of gang activity , including the wearing, possessing, using, distributing, displaying, or selling of any gang attire, symbols, signs or other things which are evidence of membership in, recruitment of, or desire to be affiliated with a gang.

3. As gang styles and clothing continually evolve and change, the following prohibited items are only representative of prohibited clothing. Additional styles and apparel may be considered gang-affiliated, as identified in consultation with school officials and law enforcement authorities: bandannas or any article of clothing bearing gang symbols, names, initials, or anything else that signals gang affiliation.


ATTENDANCE POLICY

Washington County School District recognizes that regular attendance at school greatly enhances the opportunity for students to profit from educational experiences provided by teachers. Frequent absences from classroom experiences disrupt the instructional process. The benefits of instruction, once lost, cannot entirely be regained. A positive educational process requires instructional continuity, class participation, learning experience, and study.

The “State Compulsory Education Requirements” (Utah Code, Section 53A-11-101) directs parents and schools as follows:

  • A person, parent or guardian, having control of a minor between 6 and 18 years of age shall send the minor to a public or regularly established private school during the school year of the district in which the minor resides.
  • At the age of 18 a student must continue to be excused from school by their parent or guardian unless extenuating circumstances exist.
  • It is a misdemeanor for a person having control of a minor under subsection (1) to willfully fail to comply with the requirements of this chapter.
  • A local board of education shall report cases of willful noncompliance to the appropriate juvenile court.
  • Officers of the juvenile court shall immediately take appropriate action.

FIFTH DISTRICT COURT SUPPORTS SCHOOL ATTENDANCE

The law allows parents of students enrolled in public schools to excuse their students from school only when the student is absent for a “legitimate or valid reason.”  Reasons are limited to illness or family emergency. Fifth District Juvenile Court has jurisdiction over all juveniles residing in Washington County.  The court expects that students within its jurisdiction will attend regularly the school in which they are enrolled.

           The court is obligated to adjudicate truancy matters for those students who are habitually absent without allowable excuse. To accomplish this goal, the court requires that public school officials refer students to court who violate the Compulsory Education requirement. Prior to referral, the court expects parents and schools to demonstrate earnest and persistent efforts to deter truant behavior. For the court to

adjudicate truancy, the court requires that schools write attendance policies that enforce consequences for truant behavior and teach students that such behavior is illegal and unacceptable. The Washington County School Board makes every effort to comply with state laws.  The Board works with Fifth District Juvenile Court to encourage regular attendance for all Washington County students. The Board believes this is in the best interest of students and the community. The Board directs administrators to assist parents in encouraging children to attend school.  Parents ultimately are charged with the responsibility of sending children to school.  The board has approved and adopted an official attendance policy.

PENALTIES FOR ATTENDANCE PROBLEMS

When a student accumulates 7 attendance points during a term in any class period, grades and credit for that class will be withheld until the student has completed the required restitution and a no grade (NG) will be placed on their report card.

Definitions

  • Tardy: Less than 10 minutes late to class (1 point)  
  • Excused absence:  Any absence excused by a parent guardian prior to, the day of, or two days after the return from an absence (2 points)
  • Unexcused Absence: Any absence not excused per definition of an excused absence (2 points)
  • Truancy: Unauthorized absence (NG immediately regardless of points)    

Exempt Absences: (0 points)

  • School Activity - absence due to school sponsored activity.
  • Educational travel with family or others.  Requires prior notification with approval and must include an educational component.
  • Homebound - Hospitalization or injury resulting in absences exceeding five consecutive days (requires physician’s verification).
  • Chronic Illness - absence due to chronic illness.  Requires a negotiated individual attendance plan by parents and administration (requires physician’s verification). Homebound teacher upon request of parent can be sent to the home to help student keep up with school work.
  • Court or a stay at the detention center will be considered to be exempt if the student can demonstrate participation

Medical Notes will count as an excused absence. More than 10 minutes late will count as an unexcused absence.


Hall Passes

A hall pass is required for students to be out of class. A student out of class without a hall pass is truant. This rule applies everywhere in the building, including the PE area.

Tardiness

Students are required to be in class on time.  If you are tardy you will be required to attend lunch detention. Excessive tardiness may be considered insubordination and incur serious penalties.

Parents are allowed to excuse two tardies per quarter for 1st hour only. (This should be used for extenuating circumstances only.)

Truancy

First truancy requires a parent conference.  Any concerns or needs can be addressed.  The conference includes developing a written attendance contract.   The contract could include a mandatory suspension for additional truancy or excessive tardiness.  The truancy plan will meet the district and juvenile court requirements for a referral to court.

RESTITUTION

  • Points are given for restitution.  One hour equals one point.
  • Students must attend two hours of restitution for each truancy.
  • Restitution sessions are one or two hours and cost $5.00 per hour. Sessions may be offered before school, after school, and Saturdays (a total of 50 hours per term maximum).
  • Students should attend restitution sessions immediately following receipt of a grade withheld. Grades must be resolved within the term following that term in which the grade was withheld.
  • If restitution is not completed the grade will remain a NO GRADE (NG) and no credit is given for the class. Loss of credit may impact graduation and will result in loss of eligibility for extracurricular activities.
  • Each term, when a student receives an unexcused absence the parents will be notified, at the end of the day, through a TCN call notifying the parents of the absence.
  • Each term, the school will notify parents in writing or TCN call when their child accrues two attendance points in a class period.
  • The school will notify parents each term in writing or TCN call when their child accrues three attendance points.  With seven points, the student receives a No Grade (NG).  Once the school has contacted parents, further contacts regarding attendance problems for that term is the parent(s) responsibility.                      

 PARENTAL NOTIFICATION

 APPEAL PROCESS

  • Following WCSD Attendance Policy 2900, and where extenuating circumstances apply, students may appeal a (NG) No Grade or other eligibility problem to the principal.
  • The process requires that the student and parent/guardian complete an appeals letter and submit it to the attendance secretary during the succeeding term in question.  Upon receiving the completed Appeals Letter , the attendance secretary will inform the principal who will at his/her discretion;

*          Meet with the Hurricane Middle Attendance Appeal Committee and act on their consensual decision,

*          Convene a hearing with the student, guardian and the schools Attendance Appeal Committee, or

*          Independently grant a change of grade or otherwise act in the student’s behalf.

*          Following the hearing, the committee will excuse the student and parents/guardian.  They will then make a decision and inform the student within 48 hours of their decision.

*          A subsequent rejection by the principal and/or Hurricane Middle Attendance Appeal Committee may be appealed to the Washington County School Board through the superintendent.

 

The attendance committee will consist of an administrator, a counselor and the attendance secretary.  The committee will adhere to the following guidelines:

  • A student that has all excused absences that are not excessive or accumulates more than 6 points can do an attendance appeal and will not have to attend restitution.  All grades will be restored.
  • If the excused absences are excessive (5 excused absences in the quarter), the attendance committee may not approve the appeal.
  • Students that have medical problems in the quarter, which are verified by a physician, will not have to do restitution.
  • Students with unexcused absences and excessive tardies may not be considered for an appeal.

 CONSEQUENCES FOR NON-ATTENDANCE

  • Students will be placed on an attendance contract; 
  • There will be a parental meeting to discuss the non-attendance; 
  • Students may be placed on in-school or out of school suspension; 
  • Students may go to youth court; 
  • Students will be referred to juvenile court that are habitually absent; and
  • Continued noncompliance with attendance policy may result in expulsion from School.
  • The school is liable for students during the school day, therefore students leaving during the school day(including activities and restitution)  for any reason, must have guardian permission and check out though the attendance office.  Parents or guardians will need to come in and personally sign their student out.   
  • Students, who become ill at school, must go home. If you become ill, inform your classroom teacher and report to the office. The school will contact parents/guardians to arrange transportation. If parents are unavailable, the emergency contact will be called.
 CHECKING OUT OF SCHOOL/ILLNESS AT SCHOOL

In Case of Injury, Students

  • Will be given only emergency first aid.
  • Will call parent and/or family physician.
  • Will call any other doctor or call emergency personnel if necessary.

 Medication at School  Policy #2320

Any medication given to students shall be done through compliance to the District Policy:

  • Written permission from parents or guardians.
  • Written authorization by doctor, describing amounts to be given, etc. Forms are available through the Registrar.
  • Students may carry with them no more than 2 Tylenol without signing any forms
  • Students with asthma may carry with them their inhalers.

Student Insurance

Accident insurance is made available to students. Applications are in the office.

DRESS CODE (See also “Safe Schools Policy”)

  • The attire and grooming of all students must be neat, clean, and safe,
  • Apparel that is extreme, which interrupts school decorum, or adversely affects the educational process is prohibited,
  • Students are responsible to cooperate fully with clothing, standards for specialized classes and school activities.
  • Hair, beards, sideburns, mustaches should be neat and clean-- well groomed.  Extreme hairstyles and colors are prohibited and hair color should be within the spectrum of color that hair grows naturally.
  • Printed apparel is acceptable only if it is in good taste.  Apparel displaying, profanity, suggestive language, or promoting substances illegal for consumption by a minor are absolutely prohibited.
  • Hats and sunglasses are not to be worn in the buildings during regular school hours.
  • Mutilated or immodest clothes are not appropriate for school.  Any apparel revealing a bare midriff (belly shirts), bare shoulders, or clothing that is cut low under the arms or the neck line, is not permissible.  Tank tops without a covering garment are not permissible.  Sleeveless shirts must be at least 3 inches wide at the cap and cover from neck to outside of shoulder.  Undergarments should not be visible.
  • Dresses, shorts, and skirt lengths should be modest and not revealing -- They can be no shorter than 4” from the top of the knee cap in a standing position.
  • Approved school apparel must be worn with appropriate undergarments and suitable footwear.  For health and safety reasons, shoes must be worn always.
  • Body piercing (ears excepted) is not appropriate during school hours and at school activities.  Gauging of the ears is not permitted.
  • Excessive makeup or face paint will not be permitted. 
  • Any apparel approved for school wear should be worn with appropriate undergarments and suitable footwear. Shoes, boots, flip-flops, and sandals are considered suitable footwear. Slippers are not. Shoes must be worn at all times.
  • Sagging pants is not allowed!  Pants must be worn at the natural waist.
  • Belts are to be tucked in and not hanging. Wallet chains are not acceptable.
  • Clothing attachments or accessories which could be considered weapons are not allowed.

 CONSEQUENCES FOR Noncompliance

Administrators will notify students who do not comply with the above standards and impose disciplinary actions, which include:

  • Parents (guardians) will be notified and asked to bring proper clothing to the school.
  • The student may be sent home to change.
  • The student may be suspended from school for continued noncompliance.
  • Students may borrow clothes from the office.
 DISCIPLINARY ACTIONS

Every student and situation is unique and discipline for inappropriate actions will vary with each situation. It is the philosophy of this administration that parents be contacted when their students are referred to the office for disciplinary reasons. Disciplinary actions will include, but not be limited to work hours before and/or after school, writing assignments, loss of eligibility for extracurricular activities, denial of privileges, in-school suspension, out of school suspension, referral to juvenile court, or expulsion.

SEARCHES

Students can and may be searched at anytime when there is a reasonable suspicion of a rule and or law violation. Backpacks, lockers, electronic devices, and purses may also be searched anytime there is reasonable suspicion of a violation.

CRIMINAL TRESPASS ENFORCEMENT  Policy # 5220

The purpose of this policy is to provide local law enforcement the authority to enforce compliance with UCA code 53A-3-503 and 53A-3-504.

2.1 Unauthorized use of Washington County School District property is prohibited.

2.2 It is the policy of the Washington County School Board that local law enforcement has the authority and will enforce all trespass and loitering laws on Washington County School District property.

2.3 It is the policy of Washington County School District that all traffic and parking laws will be enforced by local law enforcement on Washington County School District property.

2.4 It is the policy of Washington County School District that all persons and vehicles entering school property are subject to search.

POLICE INTERVIEWS

Police have the right to question any student 14 years of age and older without parent permission.  Students may request their parents to be there at any time.  A school official will be present when possible.

SEXUAL HARASSMENT

Washington County School Board policy prohibits sexual harassment among employees and/or students or to its employees and/or students.  The administration fully supports the school board Policy (WCSD policy 1420) and will take action to prevent sexual harassment in any form. 

 STUDENT RIGHTS and RESPONSIBILITIES               

Students have the right to:

  • Attend School
  • Dress to express personality (without being a disruption) 
  • Appropriately express opinion verbally or in writing
  • Expect the school to be a safe environment
  • Expect that school personnel would be concerned about the education of all students
  • Have due process in time of disagreement with staff members

Students are responsible to:

  • Become informed about and follow established school policies and guidelines in all school related activities
  • Respect the rights of others
  • Recognize that libel, slander, and obscenities in written and/or verbal expressions are illegal
  • Avoid sexual harassment in all communication (see WCSD Policy 3-62)
  • Gain all possible knowledge in subject areas
  • Dress modestly with cleanliness and safety in mind
  • Create a positive image for HMS in words and actions
 Due Process

All students have a right to due process and are entitled to representation.  The school administration will contact parents when legal matters are at stake.  In school related issues, the principal stands en loco parents until parents can be present.  Washington County School Board and the administration at Hurricane Middle School is concerned that the exercise of authority in the school setting is fair and that students’ rights are protected.

 Citizenship

HMS uses the following citizenship scale.

 Textbooks and Library Materials

Textbooks are the property of the school. Students are held accountable for books issued to them. Fines are imposed for undue wear or damage. If books are lost, students are responsible for their cost. Library materials are also the property of the school. Any damage or loss of these materials will also be charged to the student.  Cell phones and any electronic devices are not allowed in the library at any time included before and after school.

 

Lockers

Applications to use a locker can be obtained from the registrar. Lockers are not to be shared.   Lockers can only be used before school, right before lunch, right after lunch, and after school. Lockers are only to be used to store coats, lunch boxes or sacks, and equipment to be used for after-school activities and teams. It is a privilege to use a locker. Any misuse of the above stated conditions will result in the student losing that privilege for the rest of the school year. If a student is accessing another student’s locker, both will lose the privilege of using a locker.

HMS is not liable for anything stolen from, or damaged in your locker. Don’t bring anything of value to school. Don’t give your combination to any other student.

Students must also make sure that everything, including backpacks are locked in the lockers in the PE locker room during PE.

 Nuisance Items

Items not directly associated with education (i.e. I-Pods, radios, CD players, electronic games, laser pens, beepers, cell phones, cameras, water guns, balloons, rubber bands, stuffed animals, etc..) should not to be brought to school, and may be confiscated.  Electronic devices of any kind including cell phones are not allowed in the Media Center at anytime.  (These items often cause disruptions and may be targeted for theft.)   Don’t bring valuables to school. If you must bring something of value to school check it in at the office and we will keep it safe.  Electronic Devices and cell phones are to be unseen, secure and turned off during school hours. (8:13am-2:37pm) or they will be confiscated.  Do not let other students use your property.  If a student is sent to the office for any kind of disciplinary action the student’s electronic devices and cell phones will be confiscated for the time spent in the office and returned to the student when they leave the office.   Complete cell phones policy is available at Registration desk.

Bicycle Safety

Students must obey all traffic regulations when riding to and from school. Be sure bikes are chained and locked in the bike racks. Bikes and bike rack areas are off limits to students during the school day. We also encourage the use of helmets. Bikes are not to be ridden on campus.

Skateboards, scooters, bicycles, shoes with wheels, and roller blades are not to be ridden on campus.

 Bus Transportation

Bus Transportation is a privilege. If you misbehave on the bus, an official complaint will be filed by the driver. You will be counseled, warned, and you may have your bus transportation privilege suspended! Your parents will be notified. Do exactly what the driver tells you to do!

1. Use the same conduct as in school.

2. Be courteous.

3. Use no profane language.

4. Do not eat or drink on the bus.

5. Keep the bus clean.

6. Do not destroy any part of the bus.

7. Stay in your seat.

8. Keep head, hands, and feet inside bus.

9. Bus driver may assign seats.          

Students may ride the bus to the high school with principals permission for school sponsored activities only. They must receive a pass from the counseling center. Students found in the high school (unless participating in school-sponsored activities) may be cited for trespassing.

Only students who live in a specific bus boundary can ride the bus, non regular bus riders will need to apply for space available. The form is available from the registrar and will need to be approved by the transportation department before a non rider may ride a bus. Bus hopping to go to a friends house is not permitted.

Visitors  Policy 2960

Parents are always welcome and encouraged to visit the school and their child’s teachers. For the safety of our students, all visitors must report to the main office immediately upon entering the building and sign in. Because of the interruptions to classroom activities, campus routine and the size of the classes visitors other than parents will not be allowed to spend time at school. Only registered students may attend classes or lunches.  Trespassers will be referred to the police.

Fire and Emergency Drills

Fire and emergency drills at regular intervals are required by law and are an important safety precaution. It is essential that when the fire alarm goes off, everyone obeys instructions and clears the building by the prescribed route immediately. Each classroom teacher will give instructions. Remain outside until the all-clear signal.

Telephone

Phones are available for student use. One located outside main office on the wall by the awards case, another inside the office.  Students must check-in with their teachers before using a phone during class time. Students without a hall pass signed by a teacher will not be allowed to use a telephone. A student who uses a phone between classes and does not make it to class on time will be marked tardy. No passes will be given.

Student clubs

If you are interested in starting a school club, please follow District Policy 3640 at  (http://washk12.org).  Remember applications are due by January 15th of each year.

 Activities

There will be a variety of activities and assemblies presented during the year.  Students may earn participation in these activities through good grades, citizenship and attendance. Those students who misbehave during assemblies and activities will be sent to detention and will be denied the right to attend future activities.
